Mexico Retreat TERMS & CONDITIONS

NON-REFUNDABLE:

I acknowledged that all sales are final for the Mexico retreat, and Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute does not offer any refunds. I recognize and agree that you shall not be entitled to a refund for any purchase under any circumstances.

RETREAT DETAILS:

a. Holbox Retreat: Support as Defined by Offer PurchasedClient understands they are purchasing participation in the Erin Nicole Coaching Retreat held in Holbox, Mexico.The retreat experience may include, but is not limited to:
• Nervous system and subconscious work• Workshops and teachings• Group integration sessions• Community connection experiences• Optional curated activities or excursionsThe Coach may elect to provide additional sessions, teachings, or experiences when deemed necessary. Should this occur, Client will not be billed for additional services. However, the performance of additional services in one retreat does not obligate the Coach to provide such additional services in future retreats.Transportation + Lodging is not included. A welcome ceremony, lunch and dinner for Tues-Thursday is provided.

COVID WAIVER:

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. 

I further acknowledge that Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.

I further acknowledge that Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff, and other clients and their families.

I voluntarily seek services provided by Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending the Mexico Retreat.

I attest that:

* I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.

* I have not traveled internationally within the last 14 days.

* I have not traveled to a highly impacted area within the United States of America in the last 14 days.

* I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19. 

* I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities.

* I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.

*Please also note Erin takes a COVID-19 Test before facilitating any retreats or events.

I hereby release and agree to hold Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the retreat, or that may otherwise arise in any way in connection with any services received from Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute. I understand that this release discharges Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute from any liability or claim that I, my heirs, or any personal representatives may have against the salon with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute. This liability waiver and release extends to the group together with all owners, partners, and employees.

MEXICO RETREAT WAIVER:

Confidentiality 

  1.   This Agreement is considered a mutual non-disclosure agreement, meaning both Client and Coach agree not to disclose, reveal, or make use of any confidential information learned by either party during discussions, coaching sessions, calls, emails, or otherwise. Such “Confidential Information” includes, but is not limited to, financial information, coaching strategies, exercises, or other methodologies Client learns as a result of working with Coach, plans or outlines for future programs or packages, information contained in documents or any other original work created by Coach, and any and all other intellectual property (discussed below.)
  2.   Client and Coach agree that the responsibility to refrain from disclosing or sharing any and all Confidential Information learned as a result of Client working with Coach shall survive the expiration of this Agreement and Coach’s services. This means Client and Coach both agree to continue to keep Confidential Information private, even after the completion of working with Coach.
  3.   Should Client breach this provision and disclose confidential or proprietary information belonging to Coach or another participating in the Program, Client understands additional action may be taken by Coach up to and including legal action.

Activities

  1.  Client agrees to fill out emergency contact and medical forms before attending.
  2. Coach is not responsible for any damages during transportation and is released of all liability while traveling to, during, and from retreat.
  3.  Participant Health & Physical Activity WaiverClient understands retreat activities may include:• movement• somatic practices• emotional processing• nature experiences• light physical activityClient agrees they are physically and emotionally capable of participating and assumes responsibility for their health and wellbeing.
  4. Travel & AccommodationUnless otherwise stated in the offer purchased, Client is responsible for:• airfare• transportation• lodging• travel documentation• passport requirements• personal expensesTravel insurance is strongly recommended.Coach is not responsible for travel disruptions.
  5. International Retreat Location AdjustmentIf travel advisories, safety concerns, government restrictions, weather events, natural disasters, or other international circumstances affect the feasibility of hosting the retreat in Holbox, Mexico, Coach reserves the right to relocate the retreat to another destination.The new destination may be within Mexico, the United States, or another retreat location selected by Coach.This relocation does not constitute cancellation and does not entitle Client to a refund.
  6.  Travel Disruption ClauseCoach is not responsible for travel disruptions including:• airline cancellations• illness• weather• political restrictions• government travel advisories.
  7. Force MajeureCoach shall not be liable for delays or inability to perform retreat services due to events beyond reasonable control including:• natural disasters• pandemics• government restrictions• venue closures• weather events.Coach may reschedule or relocate the retreat if necessary.
  8. Retreat Schedule DisclaimerRetreat schedules and activities may shift based on:• weather• venue logistics• facilitator availability• group needs.Coach will maintain the integrity of the retreat experience.

Intellectual Property Rights 

  1.   Client agrees and understands that Coach has created numerous original, creative works in connection with the Program, and agrees that Coach maintains all copyrights and other intellectual property rights in all original or derivative content associated with or included in the Program, whether created prior to working with Client or specifically for Client, including but not limited to: documents, charts, emails, graphs, products, systems, processes, handouts, worksheets, tutorial videos, trade secrets, marketing strategies, Facebook ad strategies, guides, and any other original work created by Coach. Client agrees she may be granted a limited right to use selected materials in the course of his or her own business, but understands that the rights remain with Coach. Nothing in this Agreement shall constitute a transfer of ownership of any Intellectual Property from Coach to Client, nor grant any license to use the information, other than that which is expressly provided throughout the course of the Program.
  2.   Client agrees and understands he/she is not to copy, repost, alter, publish, sell, assist others in selling, manipulate, distribute, or in any way exploit any of the content or intellectual property provided by Coach or obtained through working with Coach, without Coach’s express written consent. If such behavior is discovered or suspected, Coach reserves the right to immediately end your participation in the Program without refund, as well as access to any program or materials you may have purchased, without refund, and reserve the right to prosecute any actionable infringement or misuse to the full extent of the law.

Licensee Rights: Coach’s Limited License to Client: Client understands that in purchasing the Program, she/he is gaining access to view all content and information available as part of the Program, as well as any additional information or content shared with him/her by Coach as she sees fit. Client understands this means he/she will have been granted a limited, revocable, non-transferrable license to read and use the information provided for use in his/her business and life, as instructed or allowed by Coach. As a “Licensee,” Client understands and agrees that Client will not:

  1.     Copy, edit, distribute, duplicate or steal any information or any Content obtained through Program without written permission by Coach;
  2.     Post, distribute, copy, steal or otherwise use any portion of the Program or its content without written permission by Coach, and understand that any such use may constitute infringement, which may give rise to a cause of action against Client.
  3. Share purchased materials, information, content with others who have not purchased them.
  1.     Client further acknowledges and understands that any such actions including but not limited to those outlined above will likely constitutes infringement and/or theft of our work, and a violation of this Agreement and United States Federal laws.
  2. I understand that breathwork, hypnosis, TIME Techniques (Trademark symbol) is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and I will not use it in place of any form of therapy. I recognize that breathwork requires emotional, physical, and mental effort, exertion, and behavioral experimentation, on my part, which may cause physical, mental or emotional injury. I fully acknowledge and take full responsibility for all the risks involved. I understand that it is my responsibility to consult with my health care provider prior to participating in the program. I also understand if pregnant, I will not partake in breathwork.

In the event that I am injured, I agree to assume any financial obligation, either through my personal health insurance, or through some other means, for any medical costs I incur. Erin Nicole Coaching assumes no responsibility for any medical expenses, injury, or damage suffered by me in connection with the use of any facilities or services in connection with the program.

IN CONSIDERATION OF MY PARTICIPATION IN THE PROGRAM, I HEREBY GENERALLY RELEASE, AND PROMISE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ERIN NICOLE COACHING, AND THEIR RESPECTIVE AGENTS AND EMPLOYEES (THE “RELEASE PARTIES”), FROM ANY LIABILITY WHATSOEVER.

I will reimburse Erin Nicole Coaching for any damages, reasonable settlements and defense costs, including attorney’s fees, that they incur because of any such claims made against them. I agree that the terms of this agreement, including the indemnification obligations in this paragraph, will be binding on my estate, and my personal representative, executor, administrator or guardian will be obligated to respect and enforce them. This RELEASE does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that applicable law does not permit to be excluded by agreement. 

I agree that the purpose of this agreement is that it shall be an enforceable RELEASE OF LIABILITY AND INDEMNITY as broad and inclusive as is permitted by California law. I agree that if any portion or provision of this agreement is found to be invalid or unenforceable, then the remainder will continue in full force and effect. I also agree that any invalid provision will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the agreement.

I understand that this is a contract that affects my legal rights, and I have read and understood this form and all its contents, and I voluntarily agree to the terms and conditions stated above.

PHOTO RELEASE WAIVER: 

During the normal course of attending Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute, you may be photographed, recorded by video equipment, surveillance equipment and audio equipment by members, staff, and/or guests. By signing this form, you grant Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute and its associates, members and staff permission to use your likeness in a photograph or other media in any and all of its publications, including website entries, without payment or compensation. Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute or its members may also edit, alter, copy, exhibit, publish or distribute this photo or media for purposes of publicizing Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute’s programs, or for any other lawful purpose. Unless otherwise stated, you will not receive exclusive rights to your images or other recorded medium. Additionally, you waive any right to royalties or other compensation arising or related to the use of the photograph or media.

Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute reserves the right to issue a new version of this agreement at any time

By signing, I hereby acknowledge that I have CAREFULLY read all of the provisions above, fully understand the terms and conditions expressed there, agree to being included in the Erin Porter/Erin Nicole Coaching/Quantum Ripple Effect® Coaching and Healing Institute mailing list, and do freely choose acceptance of the provisions of the foregoing paragraphs relating to assumption of risk, release of liability, covenant not to sue, and third party indemnification.
